1. Who we are

This website, emlycode.com, is operated by EmlyCode, a brand of DataRepo Private Limited (CIN: U62090UP2025PTC218378) ("EmlyCode", "we", "us"). DataRepo Private Limited decides why and how your personal data is processed and is the Data Fiduciary for the purposes of India's Digital Personal Data Protection Act, 2023 ("DPDP Act").

2. Personal data we collect and why

We collect only what we need. We use Google Analytics only if you accept analytics cookies, we do not use advertising or remarketing trackers on this website, and we do not sell personal data.

Your IP address is not included in the enquiry email we receive. Please don't include sensitive information (such as financial, health or government ID details) in the form.

We process the personal data you submit through our form on the basis of your consent, which you give by ticking the consent box after reading the privacy notice shown next to it. Consent is never pre-ticked and is not a condition for browsing this website.

We may also process personal data where permitted by law without consent, for example to comply with a legal obligation or a court order.

Withdrawing consent: you can withdraw your consent at any time, as easily as you gave it, by emailing hello@emlycode.com with the subject "Withdraw consent". We will then stop processing your data for that purpose and delete it unless we are required by law to keep it. Withdrawal does not affect processing that took place before it.

4. Cookies and browser storage

With your consent, this website uses Google Analytics cookies to measure how the site is used. Without your consent, no analytics cookies are set and no measurement data is sent. You can accept, decline or change your choice at any time via "Cookie settings" at the bottom of every page. We do not use advertising or remarketing cookies.

The site also stores small preferences (theme, retro cursor setting and your cookie choice) in your browser's local storage; these never leave your device. Every page loads Google's analytics script from Google's servers, which means Google receives standard technical request data such as your IP address. All fonts, icons and images are served from our own domain. See our Cookie Policy for details.

Service providers (Data Processors) who host this website and deliver our email, acting on our instructions and under appropriate confidentiality and security obligations.
Google, which provides Google Analytics and processes website usage data on our behalf if you accept analytics cookies.
Authorities where required by law, regulation or a valid legal request.
Professional advisers (such as lawyers or auditors) where necessary, under confidentiality.

We do not sell, rent or trade personal data, and we do not share it for third-party advertising.

6. Cross-border processing

We serve clients in India and the UAE, and our service providers may store or process data outside the country where you are located. Where this happens, we take reasonable steps to protect your data in line with this policy and applicable law, including any restrictions notified by the Government of India under the DPDP Act.

7. How long we keep data

Enquiries that do not lead to an engagement: kept only as long as needed to respond and follow up on that enquiry, then deleted. You can ask us to delete your enquiry sooner.
Enquiries that lead to an engagement: kept for the duration of the business relationship and afterwards only as long as required for legal, tax, accounting or dispute-resolution purposes.
Hashed IP data for spam protection: automatically deleted once the one-hour rate-limit window has passed.
Google Analytics data: kept for the data-retention period set in our Google Analytics account, after which Google deletes event-level data; aggregated reports may be kept longer.
Server logs: retained by our hosting provider according to its own retention practices and any period required by law.

8. Your rights

Subject to applicable law — including the DPDP Act in India and, where applicable, the UAE's Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data — you may have the right to:

Access a summary of the personal data we hold about you and how it is processed;
Correct, complete or update inaccurate or incomplete data;
Erase your data where it is no longer needed or you withdraw consent, unless the law requires us to keep it;
Withdraw consent at any time (see section 3);
Grievance redressal — raise a concern with us (see section 9);
Nominate another person to exercise your rights in the event of your death or incapacity.

To exercise a right, email hello@emlycode.com with the subject "Privacy request" and tell us what you would like us to do. We may need to verify your identity before acting. We will respond within the time required by applicable law.

9. Grievances and complaints

If you have a concern about how we handle your personal data, please contact us first at hello@emlycode.com with the subject "Privacy grievance". We will acknowledge and address your grievance within the period required by applicable law.

If you are not satisfied with our response, you may file a complaint with the Data Protection Board of India under the DPDP Act, or with the relevant data protection authority in your country.

10. Children's data

Our services are intended for businesses and adults. Our project request form asks you to confirm that you are 18 or older, and we do not knowingly collect personal data from anyone under 18. If you are a parent or guardian and believe a child has sent us personal data, contact us and we will delete it.

11. Security and breach notification

We use reasonable security safeguards, including HTTPS encryption, server-side validation, spam protection, restricted access to submitted data and keeping credentials out of public code. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

If a personal data breach affecting you occurs, we will inform you and the relevant authorities as required by applicable law.

13. Changes to this policy and contact

We may update this policy from time to time. The current version and its date are shown at the top of this page. If changes materially affect how we use data you have already given us, we will seek your consent again where required.
